Pursuant to Rule 161, Petitioner hereby files his Motion for Reconsideration or to Alter Judgment pertaining to the six orders of the Honorable Joseph R Goeke, Judge, USTC dated November 1st, 2007.

  1. The first three orders pertain to the above listed docket numbers and the respondent’s Motions to Compel Responses to Interrogatories and POD, filed October 29th, 2007. The second three orders were Show Cause orders signed by said Judge on said date.
  2. All six of these orders pertain to Taxpayer missing the deadline for complying with discovery of CIR. As explained before, Taxpayer was well aware of the deadlines and the necessity for compliance, but was unable to do so because he lacked the computer skills to make a proper response.
    Further, the tax service placed unnecessary and large burdens on him. The CIR admitted the NOD was incorrect which was true and then tried to lay additional penalties on Taxpayer. This was not only wrongful but confused Petitioner with no legal training.
  3. For a number of reasons, Taxpayer was unable to meet time for discovery but he has done so. Therefore Petitioner request:
    (a) That his tardiness be excused for the above reasons.
    (b) That his late discovery responses be accepted.
    (c) Since he is now in full compliance, that all orders and Show Cause orders issued againt him past or present in these cases be recalled.
    (d) That all orders signed in this case past or present pertaining to his failure to meet discovery deadlines be reconsidered by this court or altered. Since the issue is now mute due to his compliance all of these related orders should be mute and no longer applicable.
