Petitioner above hereby files her Response to Stipulations of the Commissioner dated October 16, 2007:

  1. The IRS classifies failure to file a tax return as a crime and a zero return or protest return is classified as non-filing. Therefore, the Petitioner respectfully declines to answer based on the grounds embodied in the 5th Amendment to the United State Constitution.  Specially, Petitioner asserts his protection against self- incrimination as he has a good faith belief that the answer to this question could be used against him in a criminal case. Petitioner as a citizen of this United States has a Constitutional right against furnishing information against himself which would be incriminatory or lead to incriminating evidence.  Petitioner hereby asserts that Constitutional right. Petitioner also requests immunity from prosecution so she can answer this stipulation in greater detail. Admits exhibit 1-J was attached to Respondent’s stipulation of Facts.
  2. Admits exhibit 2-J was attached to Respondent’s Stipulation of Facts. /li>
  3. Petitioner does not work for the IRS and does not know when the post office delivered the form.
  4. Petitioner does not know the date the SNOD was mailed by the IRS. Admits it was attached as exhibit 3-J.
  5. The SNOD did list those figures. Petitioner denies the figures.
  6. Petitioner does not know how the commissioner made his determinations. Contact the Commissioner for that information. Admits exhibit 3-J was attached.
  7. Admits Respondent did file those pleadings mentioned but Petitioner does not know the exact date.
  8. Admits exhibit 4-J was attached.
  9. Petitioner admits her signature is her signature. Admits exhibit 4-J was attached.
  10. Admits schedule K-1 was attached as exhibit 4-J.
  11. Petitioner denies liability, but does not know what District Counsel is planning to do.
  12. Denies wages in that amount. See paragraph 1 above.

    Petitioner does not have the accounts and records of the children’s trust.
