ORDER

This case was called from the calendar for the Trial Session of the Court at Charleston, West Virginia, on October 6, 2008. Both parties appeared and were heard. This case was recalled from the calendar on October 6, 2008. Again, both parties appeared and informed the Court that they had reached an agreement in this case. After due consideration, and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that jurisdiction is retained by this Division of the Court. It is further

ORDERED that this case is remanded to respondent's Office of Appeals for the purpose of conducting and administrative hearing. It is further

ORDERED that respondent shall offer petitioner an administrative hearing at respondent's APpeals Office located closest to petitioner's residence (or such other place as may be mutually agreed upon) at a reasonable and mutually agreed upon date and time, but no later than January 5, 2009. It is further

ORDERED that the parties shall, on or before January 20, 2009, file with the Court a joint report or separate reports as to the then present status of this case.
