Dear District Counsel,
I will be making a formal request for production of documents for the below listed material. This is my informal discovery to see if your office will cooperate.
I am requesting that you furnish me with the following information which may be submitted informally by mail:
Please send me all of your copies of the below listed documents.
1. Copies of all authenticated, non-hearsay wage statements, W-2’s, 1099’s, etc.
2. Copies of all authenticated 1099’s or all forms, which show miscellaneous payments or any other payments to me that the IRS classifies as income which are authenticated and not classified as hearsay.
3. In addition, please provide the following documents and evidence:
a. All documents that the show that the deficiency made in the Notice of Deficiency is correct and accurate accurate.
b. all documents you intend to use at trial.
I should also explain the possible consequences of your not participating in meaningful trail preparation, and/or appearing for the trial. In either case, I would make a Motion to Dismiss for lack of prosecution and the Tax Court may dismiss your case and enter a decision against you.
