Notice is hereby given that Petitioner above-named hereby appeals to the Kansas Court of Tax Appeals from the final agency determination, dated January 14, 2009 which decided deficiencies in Petitioner’s state income tax.

 

This was a denial of Petitioner’s request in response to an assessment dated August 20, 2008 in the amount $72,587.75. Petitioner does not owe this money because this amount was passed through her account to other independent contractors. The business expenses for Petitioner for that year were almost the same as the gross figure used by the DOR.

 

The final assessment was based upon Petitioner being accused of not filing tax returns. However, Petitioner was not required to file or at least DOR did not prove she was required to file. The denial was incorrect since it was solely based on the allegation of Petitioner being required to file.

 

Further, the income figures came from IRS printouts which are known to be notoriously inaccurate. Petitioner’s case against the IRS is still being decided in court and the federal adjusted gross income has not yet been determined.

 

Petitioner is retired, lives on Social Security and a small pension. She has deductions, credits, unreimbursed business expenses, etc.
