2. Memo on Burden of Proof

Generally the taxpayer bears the burden of proof that the 90 day letter was incorrect. However, IRC §7491(a) paces the burden for proof on the Commissioner if the taxpayer:

  1. introduces credible evidence with respect to any factual issue relevant to ascertain his liability,
  2. has complied with substantiation requirements,
  3. has maintained all records, required, and
  4. has cooperated with reasonable request for witnesses, information, document, meetings, and interviews.

Generally those who file have made these admissions and are not able to use this burden shifting law. However, non-filers can use this new law effectively in tax court. But they must continually make an offer for an out of court settlement.

Dr. Clarkson advises you to put a request for a negotiated settlement in all your correspondence and pleadings in a tax court case.

Like most things government gives you, Social "Security" is the exact opposite of what its name would imply. Oh yes, this program sends old folks checks to help them through their reclining years after retirement. But how did they get along before Social-ism? What changed, that they have to have these contributions now but not in days of yore? (That's what the C is for in FICA -- it's actually the Federal Insurance Contributions Act!) And what overall impact is it having on the "security" of the society all around them? I hope I won't be thought rude for thinking outside this box.

Rather than answering these unorthodox questions just now, let's look at some basics about the SS "program". The following is from the website of Dr. Clarkson's longtime ally, the legendary Irwin Schiff -- see the link below for many more exciting quotes along the same lines:

1935: Railroad Retirement Board v. Alton Railroad Company, 295 U.S. 330: The Supreme Court ruled that Congress that it has no constitutional authority whatsoever to legislate for the social welfare of the worker.  The result was that when Social Security was instituted, it had to be treated as strictly voluntary.

From the ruling:

"The catalog of means and actions which might be imposed upon an employer in any business, tending to the comfort and satisfaction of his employees, seems endless.

"Provisions for free medical attendance and nursing, for clothing, for food, for housing, for the education of children, and a hundred other matters might with equal propriety be proposed as tending to relieve the employee of mental strain and worry.

"Can it fairly be said that the power of Congress to regulate interstate commerce extends to the prescription of any or all of these things?

"Is it not apparent that they are really and essentially related solely to social welfare of the worker and therefore remote from any regulation of commerce as such? We think the answer is plain. These matters obviously lie outside the orbit of Congressional power."

"To regulate interstate commerce" -- Article I, Section 8, Clause 3 of the federal Constitution -- can it be that this original, truest purpose of the fedgov's whole existence was still on the table in Congress's deliberations as recently as 1935? Lots of people now living were alive then -- what happened?

Believe it or not, participation in Social "Security" is still voluntary. Here it is in the SS application form as found in the SS administration's website. At first this may seem like an impossible situation – you are free not to join but then you'll never hold a job, right?

WRONG – – for those who believe freedom is unquenchable, and avail themselves of the Patriot Network’s long-established freedom technology. Great news: even employers are now seeing it’s no use to require employees to give a Social Security number. The new world order desperately wants to give everybody a tag like a cow in a stockyard, but seems to be getting nowhere fast.

Their new plot is to turn state drivers licenses into a national ID card for handy tagging, surveillance, trading and oppression of the masses, and it too can be defeated if enough people will get involved in that critical fight.

Have a look now at the explanatory info on the SS application form (emphasis ours). Up front they tell you the whole thing is voluntary, but look at the laundry list that follows of ways they just can’t wait to use it to track your every move, transaction and thought -- if you let them! We wish them a life.

By an odd coincidence, “SS” is also the abbreviation for Schutzstaffel, “a major Nazi military organization exclusively under Adolf Hitler and the Nazi Party” (answers.com)..........  ( -- N.W.)


SOCIAL SECURITY ADMINISTRATION Application for a Social Security Card Form SS-5

...................Sections 205(c) and 702 of the Social Security Act allow us to collect the facts we ask for on this form.

We use the facts you provide on this form to assign you a Social Security number and to issue you a Social Security card. You do not have to give us these facts, however, without them we cannot issue you a Social Security number or a card. Without a number, you may not be able to get a job and could lose Social Security benefits in the future.

The Social Security number is also used by the Internal Revenue Service for tax administration purposes as an identifier in processing tax returns of persons who have income which is reported to the Internal Revenue Service and by persons who are claimed as dependents on someone's Federal income tax return.

We may disclose information as necessary to administer Social Security programs, including to appropriate law enforcement agencies to investigate alleged violations of Social Security law; to other government agencies for administering entitlement, health, and welfare programs such as Medicaid, Medicare, veterans benefits, military pension, and civil service annuities, black lung, housing, student loans, railroad retirement benefits, and food stamps; to the Internal Revenue Service for Federal tax administration; and to employers and former employers to properly prepare wage reports. We may also disclose information as required by Federal law, for example, to the Department of Justice, Immigration and Naturalization Service, to identify and locate aliens in the U.S.; to the Selective Service System for draft registration; and to the Department of Health and Human Services for child support enforcement purposes.

We may verify Social Security numbers for State motor vehicle agencies that use the number in issuing drivers licenses, as authorized by the Social Security Act. Finally, we may disclose information to your Congressional representative if they request information to answer questions you ask him or her. We may use the information you give us when we match records by computer. Matching programs compare our records with those of other Federal, State, or local government agencies to determine whether a person qualifies for benefits paid by the Federal government. The law allows us to do this even if you do not agree to it.

4 . Your government cares

Computers The politicians promise us: Taxes are the price you pay for living in the freest country in the world. You must pay your fair share. You can trust the government. Security is its highest priority. The IRS has the highest rate of customer satisfaction in the world. Never fear, your Social Security Number will never be shared with any non-agency party.

COOSBAY, Ore. - A police survey says panhandlers outside Wal-Mart in Coos Bay can make $300 a day. Inside, it takes a clerk a week to make that much.

Police say people who have a problem with that need not look to the law - asking for money is considered protected free speech.

Coos Bay authorities say most panhandlers are not criminals.

Coos Bay Police Captain Rodger Craddock says most have lived in the city a long time and they actually have homes. Craddock says, "This is just their chosen profession."
He says most are docile, and that people should report those who are not.

Bob More, director of housing and emergency services at South Coast Community Action, says many panhandlers are there for the money - to feed their addictions.

He suggested a voucher system involving tickets people could give that are good for a meal or bed in a shelter.

6. How to use Your IRS Rebate check...

As you may have heard, each of us will be getting a tax rebate check to stimulate the economy.

If we spend that money at Wal-Mart, all the money will go to China.

If we spend it on gasoline it will go to the Arabs.

If we purchase a computer it will go to India.

If we buy fruits and veggies it will go to Mexico, Honduras and Guatemala.

If we purchase a good car it will go to Japan.

If we purchase useless stuff it will go to Taiwan
and none of it will help the American economy.

We need to keep that money here in America.
The only way to keep that money here at home is to spend it at
yard sales, since those are the only businesses still in the US!

7. Government Credit Card Misuse Found

WASHINGTON (AP) — Federal employees charged millions of dollars for Internet dating, tailor-made suits, lingerie, lavish dinners and other questionable expenses to their government credit cards over 15 months, Congressional auditors say.

A report by the Government Accountability Offic obtained Tuesday by The Associated Press, examined spending controls across the federal government in 2005 and 2006 after reports of credit-card abuse at some departments.

The review found that nearly 41 percent of roughly $14 billion in purchases — legitimate or questionable — did not follow procedure, because they were unauthorized or improperly received.

In a sample of purchases totaling $2.7 million, the government could not account for hundreds of computers, iPods and cameras worth more than $1.8 million. The Army could not locate computer items making up 16 server configurations, each of which cost nearly $100,000.

The report calls for the General Services Administration and the Office of Management and Budget, both of which help administer the credit-card program, to improve accounting, particularly for electronic equipment that could be easily stolen.

Both agencies agreed with parts of the report, but the G.S.A. administrator, Lurita Doan, said that the vast majority of federal employees used their cards properly and that many oversight measures were already in place. She said there was room for improvement but added that using the cards saved about $1.8 billion in administrative costs each year.
