1. Three New Victories
no IRS

Two tax court victories in WV!

Dr. Julie, who has for years been fighting the evil tax collectors in tax court and through the administrative process, forced the tax court judge to agree with her on two cases.

She put in for her Collection Due Process Hearing (CDPH) timely and demanded a face-to-face hearing. The appeals officer contacted her accountant who was only handling some figures pertaining to the collection activity. The tax collector then claimed that the CPA had participated in a real live collection hearing by telephone.

The Patriot Network team swang into action. The victims filed affidavits and motions before the tax court stating very clearly that no in-person conference had been held, even though it had been clearly requested. The facts were clearly on the side of right and justice and the tax court judge had to agree.

Dr. Julie also had a 90 day letter case, generally referred to as a tax liability case, dealing with an ancient Substitute for Tax Return (SFR). The IRS failed to give her credit for her withholding which was greater than the amount allegedly owed. The IRS was stuck with the 90 day letter so our brave patriot ended up with a refund of over $5,000 or a credit on another year's taxes.

Patriots win in tax court all the time, but they must follow the procedures and file their paperwork on time. The administrative law judges at the tax tribunal are not our friends, but generally are fair and honest. Patriots who follow the rules and behave themselves can and do prevail.

Victory was gained through the hard work of the Patriot Advisory team, including PN Secretary, our best CPA and a hard working dedicated physician who stood up for her rights.

GREATEST VICTORY OF THEM ALL!

Anti-injunction act tossed, maybe.

A principle tool of tyranny of the evil tax bureaucracy is the anti-injunction act (AIJA), IRC §7422 which prevents the courts from interfering with IRS collections. The Due Process clause of the Constitution requires judicial scrutiny of every adverse action against a citizen by a government agency. However, the tax collectors heretofore have been exempt from this most important Constitutional safeguard.

Dr. Tom from central FL was a victim of an over-zealous, cruel tax collector who hounded him for years. This evil tool of the NWO over-reached and laid an illegal levy on his social security check. Congress says that no collections can take place without a Collection Due Process Hearing (CDPH) under IRC §6330.

The careless tax thief levied Dr. Tom's SS check without sending him the mandatory CDPH notice. Therefore, the money stolen was in violation of federal law.

With the help of the Patriot Advisory Service, Dr. Tom filed his preliminary letter and administrative claim requesting a full refund of the unlawfully seized funds. The administrative claim clearly spelled out the wrongdoing of the agent and the amounts that must be refunded.

The top dogs of the tax bureaucracy ignored the claims for a refund so Dr. Tom exercised his rights. With the help of a famed PN attorney, Dr. Tom sued under the federal Bounty Hunter Statute for unauthorized collections under IRC §7433. Complete details of the pleadings are posted on the Patriot Network website under the left menu item Statutory Bounty Hunters.

Dr. Tom wanted a try at an injunction which is an extreme remedy and not specifically spelled out in the unauthorized tax collection act §7433. The tax attorneys for the DOJ raised the black specter of the anti-injunction act. In other similar cases, the DOJ just abandoned the levy rather than take a chance on losing their important tool of tyranny.

In this case the DOJ forced an issue: Does the UATCA trump the AIJA? The Patriot network argues that the recently passed Illegal Tax Collection Act repeals a small part of the ancient protection for illegal activities by the tax rats. The District Court Judge in DC of course ruled in favor of the tax lawyers at so-called Justice Department but allowed our famed attorney to file an immediate appeal putting the AIJA in jeapardy.

This was a significant win for us and struck fear in many top injustice department lawyers. Look for more details in future issues of the e-Patriot Cannon and on our website.

2. Patriot of the Month: Henry Link

Henry Link is one of the remarkable personages in and around the Patriot Network. He would have made Patriot of the Month long ago, but he's so busy with various worthwhile pursuits that you can't pin him down for an interview. The interview part will still have to wait, but the honor itself can't, because we're that happy to have seen Henry pass a great milestone this month in good health and happiness: his 90th birthday!

You wouldn't know it to see or experience him. Extremely warm-hearted and jovial, he is also sharp of mind — and of tongue when it's needed. Henry says exactly what he thinks on "politically incorrect" subjects when few others have the guts to. He crosses streets slowly but drives himself freely to PN meetings.

Specifically we salute Henry for having taken a righteous, well-informed stand on tax freedom and stuck with it for many years, through all the worst abuses the tax thieves could think to throw at him. They've even tried to trip him up by claiming he wasn't really married to his second wife — totally without justification. One of the first articles I had the pleasure of editing for this publication sixteen years ago was a letter Henry had written the IRS in response to some provocation by them. It stomped the issues and reminded every reader that WE, THE PEOPLE still have all our rights if we will only claim them properly.

Part of his stand, it should be noted, is his firm loyalty to Dr. Clarkson. This is not cant, nor filler, nor jive talk — because candidly speaking few people Dr. Clarkson has helped have show any appreciation. Henry can get emotional when speaking of Dr. Clarkson's accomplishments and sacrifices for the supposed Land of the Free. Perhaps he sees things others don't, having lived from the end of World War I to the age of the camera-internet-jukebox-alarm clock-instant messaging-cell phone.

The System is still chasing him but, like a hamster in a wheel, not getting anywhere. This is because in addition to his own resourcefulness, Henry consults with Dr. Robert Clarkson on how to deal with the ravaging beasts. And the way things are looking he will not only outlast their claims but the IRS itself. The System is reaching the point at which there's simply no more blood to squeeze out of the proverbial stone!

Henry is an all-around patriot. A devout Christian, he knows his theology in its most "politically incorrect" reaches. He eats healthy and lives simply — two of the factors in which some of us are woefully behind the curve. He is the father of four grown children and the former husband of two wonderful, regrettably deceased ladies. Our upcountry family of activist-revelers is blessed to have an elder statesman like Henry to look up to.

3. America's Magic Mirror

Mirror, mirror, on the wall — how many months till the dollar's great fall? Nobody knows, but most thinking people are convinced it's inevitable — and imminent, all owing to the shell games politicians play with money and its various crazy knockoffs.

Through the very real hidden tax of inflation, the "real" income tax systems that crush the working man while pampering corporations and the super-rich, and the banishing of precious metals from the equation, politicians have a good racket going. Or so they have thought, till their banking hi-jinks have reached their natural, obvious end and untold billion$ — possibly trillion$ — in funny money are fecklessly thrown at the problem.

Some years ago — not that long, actually — most countries' currencies were backed by gold and/or silver. It was a different world! Income taxes were much smaller and America and various European countries had brought order and security to the lives of many third-world countries through means such as systematic agriculture and stable money. But today, these "liberated" African countries are in hell as the old modes of insane tyranny have made a brutal comeback. One of them in particular is almost certainly an image of where every first-world country is now headed: ex-Rhodesia, or Zimbabwe.

We make such a dire and extreme-sounding statement only to shock people back to reality: it's not merely that America is deteriorating. It is going communist just as Rhodesia, South Africa, Congo et al have, and will pay the same price as they if we Constitutionalists do not prevail.

Behold, ZIMBABWE — a country on the gas coupon standard in which few can afford to own a car, a land whose legal tender, the "dollar", routinely has handfuls of zeroes added to or subtracted from it.

Gasoline coupon is latest currency in Zimbabwe

HARARE, Zimbabwe (AP) - Reeling from the highest inflation rate in the world, barred by the government from using U.S. dollars for purchases, Zimbabweans turned to a new money source Wednesday: gasoline coupons.

The move reflected the complete chaos of Zimbabwe's financial system, where prices are openly quoted in the American currency, in Zimbabwe's own new currency that came out Friday, and in its old denominations, which have 10 more zeros than the new bills.

Even coins have returned to circulation after being abandoned in 2002.

Auctioneers Hammer and Tongues announced the first "auction by barter" to be held Friday. Dozens of cars and other goods will be up for bids payable in gas coupons instead of hard currency and the government says the system is legal, the auction house said Wednesday.

"Homegrown solutions for Zimbabweans. Now we are selling in liters (gallons) not in dollars," the statement said.

Bidders must put down a deposit of 1,000 liters (220 gallons) of gas coupons, worth about $1,500 at the current gas price in Zimbabwe, and pay the rest in coupons when they pick up their purchases.

Zimbabweans face acute shortages of local currency. Already gas coupons can be used to pay some household accounts. Many businesses also pay workers part of their earnings in scarce foodstuffs, or demand dollars for purchases, which is illegal.

What's the first thing people say when you tell them you don't pay income taxes? Most likely they ask "But if everybody did like you, how would our roads and bridges be maintained?" Now you can give them the proof from none other than the New York Times: income taxes do not finance roads.

The naïveté of the masses is striking. (Admittedly, I was there once.) They pay hundreds or thousands a year per family for gasoline, forgetting that a portion of the price of every gallon is TAX. The exact amount used to be posted on gas pumps.

Liberal Wikipedia, too, cries uncle on this subject:

"In the United States, the fuel tax receipts are often dedicated or hypothecated to transportation projects so that the fuel tax is considered by many a user fee. In other countries, the fuel tax is a source of general revenue."

Here's more on gas prices per gallon:

In South Carolina according to the Spinx fuel company:
federal tax = 18.4 cents
state: 16 cents
inspection and environmental impact = less than 1 cent total

For the first quarter of 2008, the average state gasoline tax is 28.6 cents per US gallon, plus 18.4 cents per US gallon federal tax making the total 47 cents per US gallon (56 ¢/imperia gal; 12.4 ¢/L). The American Petroleum Institute tells me the federal portion has been 18.4 cents since Oct. 1997. If (for instance) South Carolina's other figures have also been constant, that would mean that in that month, 35 cents or over one-third of the price per gallon ($1.20) would have been taxes.

Now, here's the pièce de résistance: The NY Times' socialistic lament that our roadways are hanging in the balance because of the low ebb in a Fund "financed by federal excise taxes on motor fuel, 18.4 cents a gallon on gasoline and 24.4 cents a gallon on diesel." Surely your friends will believe it from the Times!

Please note that the safety of drivers is almost a footnote in these discussions, but it is included under things facing "grave repercussions" from the crisis.

Perhaps you're wondering why I used the word "socialist" above? In my humble opinion, government is not supposed to be in the business of building or maintaining roads. Don't be shocked: some American highways are privately owned — in some cases by foreigners.

The Times's hand-wringing is also socialist in that it shows government and media looking to the people for ever more handouts to cover for bureaucrats' waste and corruption. Why can they never get the job done within their bloated budgets — what's this nonsense about low funds because people aren't driving enough? Predictably, super-socialist Sen. Charles Schumer is in the middle of the scene, shrilly blaming the Busheviks for the crisis. They are guilty as sin for it, but that's no free ride for Democrats — they are at least as guilty.

Please note that there is never any shortage of funds for governments' spying on and persecuting their critics, for open-ended wars (two billion dollars per week for Iraq!), bailouts for their fellow fat cats, foreign giveaways to enemies, grants for deranged "art" projects, and stipends for the study of stupid nonsense.

When they want billions for the latest hoopla, they've got them instantly. How do you suppose that works?

5. It's Thanksgiving time again

Wow, what a year. An extreme communist for president (and another one waiting in the wings for January) — the economy seemingly reaching the end of the line — America literally burning from drought and human carelessness (or worse). The end of November is coming and stores are hawking turkey deals, but what is there to be thankful for?

If we're doing our job right, we should be overwhelmed with feelings of gratitude. For the present, things continue more or less normally for many of us, or at least as per usual. The dollar was supposed to be dead and buried by now, and whether it's actually doomed is, as long as it's still standing, strictly speaking not knowable.

If you have a job, be thankful — even if you don't like it. If you are passably healthy, be thankful — even if you're "old" or can't physically do everything you'd like or you "used to could" as they say here in Dixie. But even if you're sick or unemployed, I daresay you too should be thankful: let any memories of health or employment spur you on to new progress in those areas if conditions allow. If that progress is truly not circumstantially possible, perhaps you can somehow help others to appreciate what they have — or encourage them to maximize it — or simply offer them a much-needed cheerful word?

Am I getting sappy? Maybe..... or is our problem that we too easily lose track of the basics, in some cases only touching upon them when life jabs at us?

Since you're likely reading this in digital form, it would seem the internet is still screwed together. Do you know what a miracle that is — really and truly? Even as foreign governments are grappling to shut off online freedom, we've still got it to an incredible degree. This, friends, is truly a victory in itself, and due solely to PEOPLE POWER.

All of this goes back to the Force who never changes — the true and living God who made us and everything else that is. It's to HIM we should offer heartfelt thanks and praise for not smashing us flat for our sins and evils. If you are a grateful person or can at least conjure up some gratitude when you think about it, be grateful for it. That itself is a gift — yes, from God, without which we are and have NOTHING.

Just think: so far we've mentioned......
