Informal Discovery

Dear David M. McCallum

Petitioner Philip J., pursuant to Rule 72 of the Rules of United States Tax Court, hereby requests that you furnish me with the following information within thirty ( 30 ) days, which may be submitted informally by mail:

I will later be making a formal request for production of documents for the below listed material. Please send me all of your copies of the below listed documents.

1. Copies of all authenticated, non-hearsay wage statements, W-2’s, W-4’s, 1099’s, etc.

2. Copies of all authenticated, 1099’s of all forms which show miscellaneous payments or any other payments to me that the IRS classifies as income which are authenticated and not classified as hearsay.

3. In addition, please provide the following documents and evidence:

a. All documents that show that the deficiency made in the notice of deficiency is correct, accurate, and

b. all documents you intend to use at trial.

c. All documents that I submitted in this case the IRS considers frivolous and groundless

I should also explain the possible consequences of your not participating in meaningful trail preparation, and/or appearing for the trial. In either case, I would make a Motion to Dismiss for lack of prosecution and the Tax court may dismiss your case and enter a decision against you.
