Dear Tax Collectors,

You sent me your CP-91 “Final Notice Before Levy On Social Security Benefits” dated March 12, 2007. A copy is attached.

This notice is for tax year 2001. I have a CDPH pending. The CDPH for 2001 is in Tax Court, Docket #171-07.

IRC §6330 clearly states that you cannot levy or take any collection enforcement action until the CDPH and all appeals have been resolved.

Placing a levy on my Social Security benefits for this tax year would be a serious violation of my rights. I will be able to take recourse against you under the Legal Tax Collection Act IRC §7433.

Also, I have changed my mailing address. Please note my new mailing address in the upper right hand corner of this letter. All future correspondence should be sent to this address.
