Petitioner, Nathan R Patriot hereby files a motion to Extend Time to file an opposition to Chief Counsel Donald L. Korb, via Amy Dyar Seals, Senior Attorney’s Motion To Show Cause Why Proposed Facts In Evidence Should Not Be Accepted As Established, dated filed November 15th 2005.
IN SUPPORT THEREOF, Petitioner, Nathan R Patriot respectfully states:
1. Motion filed by Chief Council to Show Cause Why Proposed Facts In Evidence Should Not Be Accepted As Established makes no sense at all, since I have been trying to retrieve records to comply with counsels request to work toward a settlement in this case. I need to find my records to bring this to a settlement, and Counsel has been made aware of this.
2. Chief Counsel’s motion dated November 15th states at number 5 that Petitioner Nathan R Patriot was “Served” on November 15th, 2005. Nathan R Patriot was not “served” on said date. He “received” the motion on the Nov. 17th, 2005. How can Respondent predict when Petitioner is served when Petitioner has not been served on November 15th.
3. Counsel says at number 6. that “Petitioner Objects to the granting of this motion…” How can counsel know what my thoughts are seeing that I am not represented by Chief Counsel Donald L. Korb, or Senior Attorney Amy Dyar Seals. Is Counsel trying to represent me? I make my own decisions as I am of age, and capable of doing so.
4. I was contacted, I believe by phone, by Counsel Amy Dyar Seals, and was told that all I needed to do was Sign her Stipulation Of Facts that she was sending me. When I received said Stipulation Of Facts, I noted at number 2 it is stated “Petitioner did not file returns for the 2001, or 2002 taxable years.” That is not true, and I could not just sign that it was without objection to that stipulation. It is my understanding according to the “Privacy Act Notice” that you are required to file either a return or statement for each taxable year. I did file returns, and or statements as directed by the Privacy Act for years 2001, and 2002.
5. As to number 4 in Respondents Stipulation of Facts, I objected as I did not prepare those figures, and could not sign that they were true as the Stipulation Of Facts indicated they were.
6. I request thirty days Extension of Time to figure out what Counsel is talking about, and to file an opposition to her Motion To Show Cause Why Proposed Facts In Evidence Should Not Be accepted As Established, due to the poor quality of the motion Petitioner must seek outside Counsel, and will need additional time to do so.
