Re: Follow up of Stay Letter to IRS Third Party Summons.

Gentlemen:

A short time ago, I sent you a “Stay Letter in Response to Third Party Summons” to halt your compliance to a Form 2309-A Summons issued by the Internal Revenue Service under IRC § 7609. The purpose of the “Stay Letter” was to stop your company from delivering to the government any of your documents, records, financial information, etc. pertaining to me.

The purpose of The Special Procedure for Third-Party Summons Act, part of the Tax Reform Act of 1976, codified under 26 USC § 7609 was to protect the taxpayer from abuse of his statutory rights to his privacy from an administrative summons.

Despite the clear intent of the Congress and the plain meaning of the said act, the Tax Service now seeks to evade its responsibility. Actually, the US Attorney and the IRS as in many other cases may not even notify me, even though the summons form provides:

“The Internal Revenue Service may begin an action to enforce the summons in the United States District Court. In such cases you will be notified and you have the right to file suit and present your objections before the court…” (emphasis added).

Consequently I ask that you please notify me if or when any further action is taken in this matter by the IRS or by the US Attorney wherein they may be seeking or obtaining an order from the US District Court. Since, as explained above, I may not be served a copy of the enforcement order, or otherwise be notified, I ask that you please send me a copy of any paper served upon you.

Also, I specially request that you demand from the US Attorney proof of service in the event of a court order prior to turning over any records pertaining to me and that you notify the court of the problem set forth above if you answer any government pleading.
