Petitioner moves that Tax Court Judge Mary Ann Cohen, before whom certain motions in this case are now pending and may in the future be placed, recuse herself on the following grounds:2. Cohen has accused Petitioner of “instituting or maintaining this case primarily for delay” (see judges order dated________________) when it is within the Petitioner’s legal right institute these proceedings.
3. Petitioner performs life saving functions and surgeries in her field of expertise to an extent which no other physician is capable of doing within the same region. Petitioner has stated this several times and has tried to cooperate fully with opposing counsel and the Court to the best of her ability and busy schedule of over 8,000 active patients.
4. Cohen has instituted unreasonable time frames for meetings and filing of motions.
5. Cohen has previously proven to be an unfair Judge as documented in Ballard v. Commissioner of Internal Revenue (see enclosure).
6. Petitioner requests that Cohen proceed no further in this ease and another Tax Court Judge be assigned to hear the proceedings, any further motions, and the motion filed herewith.
