RE: Letter dated June 18, 2009

Dear Ms, Williams,

In response to your letter dated June 18, 2009, I will once again reiterate my request for a face-to-face hearing as per IRC section 6330.

In your letter you state that any request for documents should be made to the disclosure office in Cincinnati. Yet you have set the date for this telephone conference for June 25, 2009. Even if I were amicable to this, which I am not, it would obviously be impossible to secure said documents before June 25.

Additionally, in order for you to make a determination you must have some type of documentation, yet you refuse to provide me the information that you possess. In my previous letter dated June 15, 2009 I specifically request that YOU; “provide a copy of all information, documentation and the administrative records you have on me before the CDP Hearing. Please send me Form 4340 with the transcripts and certificate. This is necessary for my CDPH.” Are you claiming that you have no documentation, if so what will be the basis for your determination?

I have met all the requirements by law which entitle me to a face to face hearing yet you continue to place impossible demands upon me in order to violate my rights to a fair hearing as prescribed by Congress in section 6330 of the IRC.

Sincerely,

Randy Freeman
