REPLY TO PETITIONER’S OBJECTION TO RESPONDENT’S MOTION TO DISMISS
Respondent, Donald Patriot, hereby files his reply to Petitioner’s objection dated May 18, 2006 of the IRS to respondent’s motion to dismiss (5th Amendment) based on the following reasons:
The government’s objection essentially agreed with respondent’s position.
Respondent knows very well he can not assert a blanket Fifth Amendment privilege against self-incrimination. Respondent filed a motion stating his position that he has a constitutional right to object to self-incrimination. Respondent will submit to the judge, in camera, his evidence of a legitimate and real fear of federal criminal prosecution.
Respondent requests immunity from the Department of Justice for any testimony and records in this case. Respondent requests a judicial tribunal on claim of privilege.
In conclusion, respondent requests that this court allow him to exercise his constitutional rights unless the DOJ grants immunity.
